Supreme Court upholds health care law, and, according to Texas Gov. Rick Perry, 'has abandoned us'

Stunning partisans on the left and the right, the Supreme Court this morning upheld the Patient Protection and Affordable Care Act by a vote of 5 to 4.

Chief Justice John Roberts wrote the decision for the majority comprised of Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor. Justices Samuel Alito, Anthony Kennedy, Antonin Scalia and Clarence Thomas were in the minority.

The Supreme Court majority came to its conclusion by deciding that the individual mandate in the 2,000-page Affordable Care Act, requiring citizens who chose not to buy health insurance to pay a penalty was, instead, a tax.

The court also ruled unconstitutional the authority of the federal government in the so-called ObamaCare bill to withhold federal funds from states refusing to cooperate in the expansion of the Medicaid program.

Gov. Rick Perry today said the ?Court utterly failed in its duty to uphold the Constitutional limits placed on Washington,? in a statement issued to the press. ?Now that the Supreme Court has abandoned us, we citizens must take action at every level of government and demand real reform, done with respect for our Constitution and our liberty.

?Freedom was frontally attacked by passage of this monstrosity. Obamacare is bad for the economy, bad for health care, bad for freedom. Americans have made clear their overwhelming opposition to its convoluted, burdensome and overreaching mandates.?

The reasoning for upholding the Affordable Care Act as a tax rather than a mandate is certain to be the subject of furious legal argument.

The court?s decision refers to the mandate as a ?shared responsibility payment? to the federal government. Failure to make such a payment results in a penalty collected by the Internal Revenue Service in the same way as a tax, the ruling says.

The majority made clear that an individual mandate as outlined in the Affordable Care Act would illegitimately force individuals to engage in commerce by buying health insurance.

?Construing the Commerce Clause to permit Congress to regulate individuals precisely because they are doing nothing would open a new and potentially vast domain to congressional authority,? the Roberts decision says. ?Congress already possesses expansive power to regulate what people do. Upholding the Affordable Care Act under the Commerce Clause would give Congress the same license to regulate what people do not do. The Framers knew the difference between doing something and doing nothing. They gave Congress the power to regulate commerce, not to compel it. Ignoring that distinction would undermine the principle.?

Instead, the decision does what Congress failed to do in drafting the bill: find the reasoning for its health insurance requirement on the grounds that Congress possesses the power to ?lay and collect taxes.?

Texas? Greg Abbott, one of the 12 original attorneys general to sign on to the ObamaCare lawsuit, took note of what he called ?a novel application of the facts? in a statement he issued today from Washington, D.C.

?The Court did what Congress was afraid to do--called ObamaCare a tax on all Americans,? Abbott wrote. ?This is particularly ironic since President Obama, himself, insisted this was not a tax.?

In addition to its clearest delineation of the Commerce Clause in more than 15 years, the Court said the federal government would be in violation of the Constitution if it cut off funding to states that refused to expand Medicaid in the ways outlined in the Affordable Care Act.

Justices Breyer and Kagan joined Roberts in the opinion that Congress has no constitutional power to withhold existing federal grants as a way of compelling participation in expanding a program.

Along with the individual mandate, the forced expansion of Medicaid was the impetus for the lawsuit filed March 23, 2010, by the state of Florida against the U.S. Department of Health and Human Services.

Eventually, 26 states?would sign onto the suit decided by the court today.

The 11th Circuit Court of Appeals had ruled with the states and against the individual mandate and against the state and Congress? right to force the states to expand Medicaid.

?The threatened loss of over 10 percent of a State?s overall budget is economic dragooning that leaves the States with no real option but to acquiesce in the Medicaid expansion,? today?s ruling says.

The ruling goes on to repudiate the government?s claim ?that the expansion is properly viewed as only a modification of the existing program, and that this modification is permissible because Congress reserved the ?right to alter, amend, or repeal any provision? of Medicaid.?

"This is an historic victory for individual liberty, states? rights, and limited government,? Abbott said. ?Today the Supreme Court made crystal clear that the federal government is more restrained than yesterday. The Court also agreed that States are individual sovereigns that cannot be commandeered by the federal government. In this instance, by forcing States to expand Medicaid, the federal government tried to hold States hostage.?

Brooke Rollins, president of the Texas Public Policy Foundation called the Medicaid portion of the ruling a silver lining. ?This,? she said in a statement, ?at least protects, to some extent, the prerogatives of the states under the Tenth Amendment.?

To say that those following ObamaCare to the nation?s highest court were surprised by the decision would be a Grand Canyon-sized understatement.

Liberal legal experts and pundits were all but throwing themselves off of metaphorical bridges on Wednesday. Politico?s Roger Simon concluded before today?s decision that the High Court has lost its honor, that it was accountable to no one in America.

Conservative groups like the Heritage Foundation had already laid the groundwork for market based reforms, assuming the court would invalidate at least the individual mandate.

After the ruling, roles were reversed. Peter Suderman, senior editor for the libertarian Reason magazine and website, noted how different the outcome was in comparison to expectations.

?Although the overall ruling is a victory for supporters of ObamaCare, the particulars of the Supreme Court?s decision today are almost exactly the opposite of what most observers expected. It?s like a ruling from Bizarro World.?

Patrick Gaspard, executive director of the Democratic National Committee was more succinct when he tweeted, ?it?s constitutional. Bitches.?

A short time later he followed with, ?I let my scotus (Supreme Court of the United States) excitement get the better of me. In all seriousness this is an important moment in improving the lives of all Americans.?

However surprised, the ruling today changed few minds. President Obama praised the court and reiterated the justness of the Affordable Care Act in spite of it political divisiveness.

Republican presidential candidate Mitt Romney, who hoped for a repeal by the court, said the responsibility for the repeal falls now to the people.

?As you might imagine I disagree with the Supreme Court decision, and I agree with the dissent,? Politico reports Mitt Romney saying just after the ruling. "Obamacare was bad policy yesterday, it's bad policy today. If we want to replace Obamacare, we have to replace Obama.?

Arlene Wohlgemuth, health care specialist for the Public Policy Foundation, said today renaming the health care mandate a tax does not legitimize it.

?Congress now needs to act quickly to repeal this law and take a new approach to health care reform,? Wohlgemuth said. ??But this time, we need to fix health care the right way ? with patient-centered reforms that emphasize the patient-doctor relationship and allow them to make more effective and economical health care choices with less interference from insurance companies or government.?

Trevor Burrus, co-author of important amicus briefs filed in the case for the Cato Institute?s Center for Constitutional Studies, warned of irrational exuberance on the day before the ruling.

Burrus, who wrote passionately for the repeal of ObamaCare, cautioned that the Supreme Court was deciding on a single case, neither rolling back nor pushing forward the role of the federal government in the lives of individuals.

Either decision, he said, would continue to be fought in the court of public opinion.

?It?s a big decision, we all know that,? Burrus said. ?But contrary to what some have said or written, there is no sky is falling here. What we?ve seen is the expansion of constitutional interpretation to the point that it now matters so much to people who is going to control their health care choices and the choices of their kids.

?That?s the importance of this case.?

Are you like me?? You?ve always loved writing.? You dove into writing your book with relish, like a kid diving off the dock at summer camp.? It?s been a joy, a practice, a discipline and a relatively private exercise.

But then, the book is finished, and you?ve entered into a whole different realm.? Let?s say you?ve already crossed the publishing Rubicom?whether you are self-published or picked up by a publishing house.? You may have a PR firm behind you as well. But we all know that these days, marketing your book, ultimately falls upon your shoulders.

Marketing and sales are as far from the reclusive sanctuary of the writer, your head may spin, leaving you feeling flummoxed, conflicted, crazed, and overwhelmed.? I have certainly felt that way.? But I have both my 35 years of psychoanalytic practice and my Buddhist practice to draw on and share with you.

So here are ten ways I have found to undertake book marketing without losing my center. ?They all relate to:

a)???????????? CREATING A SUPPORTIVE ENVIRONMENT TO CARRY OUT YOUR PLAN;

b)???????????? SETTING REALISTIC FINANCIAL AND TIME PARAMETERS FOR YOUR GOALS; and

c)????????????? PRACTICING MINDFULNESS THROUGHOUT.

?

1)? First, reflect deeply on your intention.? Did you write this book primarily for your own satisfaction, or did you write it with the intent of seeing it widely read?? Unless your answer is the latter, stop worrying about marketing. If you wrote it to be widely read, keep that intention in the forefront of your mind throughout the marketing journey.

2)? Second, consider your support system.? What resources do you have or can you turn to to help you establish a game plan for marketing your book? Do you have a publisher and or a PR team helping you with your game plan?? If you do, make sure the plan makes sense to you and that you are clear about being on board with it.

3)? If you do not have a professional support team, what are your own resources?? How much time and money are you comfortable with allotting to the project of book promotion?? Develop a timeline and a budget that you can live with.

4)? Whether you are on your own or have PR support, you will need a good web site; you will also need a strong social media presence.? That means in addition to your personal Facebook page, you need a page for your book and you need to attract people to like your page; you need a twitter account to draw more followers.? You will also benefit from joining discussions on Linked in groups related to your area of interest, and sharing images and updates on Pinterest.? Another great site to create a writer?s presence is Goodreads. And finally, to enhance your web page and your online presence, consider doing what you love best, WRITING?how about writing a blog!?

The entry into social media can be very daunting to those writers of us ?of a certain age? and may be the most challenging to your equanimity.?? More support to follow.

5)? Consider taking courses to support you in web design, book marketing and social media.? I took a very helpful course at my local community college on book marketing and also found a great weekend course on keeping up with social media for marketing, offered by a ?social media guru? through my local chamber of commerce. ?I also met other people in my community to create a mini support group.

6)? In addition, look for online courses that can help you with marketing.? Informally joining support groups with others who are on the same path in these contexts can help immensely in maintaining your sanity!? For example, I have found Beth Hayden (www.bloggingwithbeth) enormously supportive and helpful in creating a successful blog presence.

You want to engage in marketing your book as a practice of living engaged fully in the present moment, setting aside attachments to future outcomes and worries about your performance in the past, living equanimously in the present.? This practice can be summed up with the simple but powerful mantra: ?BE HERE NOW?

8)? Make sure you frame it for yourself in a way that is fully syntonic with your personal values and ethos.? Many people find themselves very conflicted about ?selling? as if they felt they were icky snake oil salesmen at a traveling circus.? As a Buddhist practitioner devoted to ?Right Livlihood? and ?Speaking Only Truth? I had my own initial conflicts about selling my book, PULLING UP STAKES; STEPPING INTO FREEDOM (www.pullingupstakesbook.com).? But then I realized that the book itself is an act of mindfulness, it traces a journey of gaining wisdom and insight and learning how to ?let go? and live more mindfully.? So, because it is about surmounting some of life?s greatest challenges with equanimity, it is an inspiring offering. If your book is a genuine offering that you believe will benefit, illuminate, inspire and or entertain readers, and not some kind of snake oil scam, then you need to keep reminding yourself that you are offing merit not compromising your core values or behaving like a sleaze!

9)? Approach your book tour with gusto.? ?This is going to be an adventure!? I?m going to have an opportunity to talk with new people about something I really care about.? My book is my baby and I?m privileged to be able to find people interested in hearing about it!?

10) ?Engage in your daily routine at your computer doing your due diligence on your social media sites as a mindfulness practice!? Rather than seeing it as an odious chore, consider it as an opportunity for practicing mindfulness.? Pay attention to your posture, sitting comfortably, breathing consciously, communicating openly with your book?s potential audience as a privilege not a task.? Remember you are offering something of value, something from your heart and soul, it is an offering.

Alaska wreckage from deadly 1952 military plane crash

ANCHORAGE, Alaska ? The wreckage of a military plane found near Knik Glacier?earlier this month has been identified as a Korean War-era Air Force cargo plane that crashed in the 1950s, killing all 52 people on board, NBC?station KTUU?of Anchorage reported Wednesday.

The identification brings closure to victims' families after nearly 60 years, KTUU said.


Joint POW-MIA Accounting Command spokesperson Capt. Jamie Dobson said?the wreckage,?discovered June 10 on Colony Glacier, about 45 miles east of Anchorage,?by a UH-60 Blackhawk crew with the Alaska Army National Guard-- is that of a Douglas C-124A Globemaster II that crashed?on Nov. 22, 1952.

While evidence collected by the eight-man teamis en route to JPAC?s Central Identification Laboratory in Hawaii for further analysis, Dobson told KTUU?the plane was identifiable by materials found at the scene.

"Some of the evidence has already been positively correlated with this crash," Dobson told KTUU.

Harsh weather prevented a recovery at the time and later searchers could not locate it.

The Globemaster II entered Air Force service in 1950 as the world?s largest transport plane. Its forward loading ramp and aft cargo elevator, as well as its ability to carry 68,500 pounds of cargo or 200 passengers on two decks of seating, made it the Air Force's primary heavy-lift transport into the early 1960s, KTUU reported.

The four-propeller transport was eventually replaced by the C-141 Starlifter jet, but its name lives on in Alaska skies with the C-17 Globemaster III, operated by the 517th Airlift Squadron at Anchorage?s Joint Base Elmendorf-Richardson.

Crash researcher Tonja Anderson, whose grandfather Airman Isaac Anderson died in the crash, told KTUU the cargo plane was on a flight from McChord Air Force Base in Washington to Elmendorf Air Force Base in Anchorage when it crashed near the 8,000-foot level of Mount Gannett.

Google brings incremental app updates, added encryption measures to Android

Google has just announced a new feature for Google Play that's sure to please anyone who's sat though an app update that never seemed to end. It now offers what it calls "Smart App Updates," which will let developers provide incremental updates to apps instead of forcing people to download a whole new APK for every minor update. On average, Google says those should be about a third the size of typical updates. What's more, the company has also announced that it's bringing added encryption measures to Android, which will let paid apps be encrypted with a device-specific key that makes them harder to rip and share. Both features will supported on Android devices running Gingerbread or above.

As a part of it?s previously announced plan to appoint more than 1,000 small business bankers across the country by mid-2012, Bank of America Corporation (BAC - Analyst Report) announced the recruitment of 30 such bankers in Washington. Of these, 10 bankers were employed in the Seattle metro area.

BofA?s decision to hire small business bankers throughout the country stems from the fact that small businesses were facing difficulties in obtaining expertise on how to run operations and maintain finances. Hence, during early 2010, the company announced its plan to hire a wide number of such bankers.

According to the U.S. Small Business Administration (SBA), in Washington there are approximately 532,160 small businesses. These businesses account for more than 97% of all employers and employ over 50% of the private-sector workforce.

The owners of small businesses often face unique and complex financial demands. To understand the unique needs of these small business owners, customized guidance and constant attention of small business bankers are very much needed. Therefore, BofA is hiring these specialized bankers to tap the huge demand for personalized help in the region.

Through BofA?s small business bankers, small business owners will be able to access local expertise and a dedicated resource that properly understands its exclusive needs. Small business bankers will evaluate the business owners? credit, deposits, payroll and cash management needs besides providing proper guidance. This, in turn, will enable these businesses to manage finances in a better way and work more efficiently.

According to BofA, small businesses are critical to the development of the economy as a whole. In spite of their significant contribution to the economy, these do not have access to better banking facilities. Therefore, the company took such an initiative to sort out the problems faced by these and provide the owners with assistance to smoothly conduct their business operations.

In its efforts, BofA has been constantly pursuing active lending to small-scale firms. In the first quarter of 2012, the company extended approximately $106 million in credit to small businesses across Washington.

Moreover, BofA has been actively contributing to the Community Development Financial Institutions (CDFI) program by providing $200 million worth of finance to small businesses, which do not qualify for conventional loans. The CDFI program was initiated in 2010 to help some 9000 odd small businesses and maintain around 14,000 jobs.

Much like BofA, JPMorgan Chase & Co. (JPM - Analyst Report) is trying to accelerate the economic recovery by lending to small businesses. In the first quarter, it provided credit of more than $4 billion to small businesses and offered loan and raised capital of more than $445 billion for its commercial and consumer clients.

Beach pollution at third-highest level in 22 years

Beaches across the nation continue to be fouled by sewage and storm water pollution that puts swimmers at risk of getting sick, according to a report by an environmental group.

The Natural Resources Defense Council found that although the number of days American beaches were closed or posted with advisories because of contaminated water dropped 3% last year, they were at their third-highest level in 22 years.

California registered a slight increase in beach closures and advisories in 2011, most of them in response to tests revealing elevated bacteria counts, according to the group's annual "Testing the Waters" report.

"We have an ongoing legacy of pollution at our beaches, and the problem is not going away," said Noah Garrison, an attorney with the environmental group's national water program. "We need to be doing more to solve the problem."

The top source of contamination is runoff swept into the ocean by rainfall or irrigation, accounting for about 47% of the beach pollution last year. Beaches along the Gulf of Mexico continued to be hit with closures and advisories related to the 2010 BP oil spill.

The report analyzed bacterial test results and public advisories from more than 3,000 beaches in 30 coastal and Great Lakes states. A high bacteria count indicates beach water is likely to harbor pathogens that can sicken swimmers ? causing skin rashes, stomach and respiratory illnesses, and other infections. Interactive maps in the report allow readers to search by ZIP Code to find out how their favorite beach measures up.

The states with the cleanest beaches in 2011 were Delaware, New Hampshire, North Carolina, New Jersey and Florida. The most contaminated were Louisiana, Ohio and Illinois.

California, which accounted for 25% of the nation's beach closures and advisories, ranked 21st out of the 30 states in the number of beach water tests that flunked federal health standards.

Two Southern California beaches made the report's list of 15 "repeat offenders" because of their persistent pollution problems: Avalon Beach on Catalina Island and Doheny State Beach in Dana Point. Three earned a spot on the nation's one dozen "5 star" beaches with outstanding water quality: Newport Beach, Bolsa Chica State Beach and Huntington State Beach.

The report calls on the U.S. Environmental Protection Agency to strengthen a new set of beach water quality standards it is set to finalize this fall. Environmental groups have criticized some of its provisions as weaker at protecting swimmers from contaminated water than the 1986 rules they replace.

To curb beach pollution in the long term, the report says, coastal states must address the root cause and build more "green infrastructure" to absorb polluted runoff. Projects could include rain-capturing barrels, porous pavement that allows water to filter into the ground, and facilities that divert and treat runoff before it reaches the ocean.

Scientists twist light to send data

A multi-national team led by USC with researchers hailing from the U.S., China, Pakistan and Israel has developed a system of transmitting data using twisted beams of light at ultra-high speeds ? up to 2.56 terabits per second.

To put that in perspective, broadband cable (which you probably used to download this) supports up to about 30 megabits per second. The twisted-light system transmits more than 85,000 times more data per second.

Their work might be used to build high-speed satellite communication links, short free-space terrestrial links, or potentially be adapted for use in the fiber optic cables that are used by some Internet service providers.

"You're able to do things with light that you can't do with electricity," said Alan Willner, electrical engineering professor at the USC Viterbi School of Engineering and the corresponding author of an article about the research that was published in Nature Photonics on June 24. "That's the beauty of light; it's a bunch of photons that can be manipulated in many different ways at very high speed."

Willner and his colleagues used beam-twisting "phase holograms" to manipulate eight beams of light so that each one twisted in a DNA-like helical shape as it propagated in free space. Each of the beams had its own individual twist and can be encoded with "1" and "0" data bits, making each an independent data stream ? much like separate channels on your radio.

Their demonstration transmitted the data over open space in a lab, attempting to simulate the sort of communications that might occur between satellites in space. Among the next steps for the research field will be to advance how it could be adapted for use in fiber optics, like those frequently used to transmit data over the Internet.

The team's work builds on research done by Leslie Allen, Anton Zeilinger, Miles Padgett and their colleagues at several European universities.

"We didn't invent the twisting of light, but we took the concept and ramped it up to a terabit-per-second," Willner said. His team included Jian Wang, Jeng-Yuan Yang, Irfan M. Fazal, Nisar Ahmed, Yan Yan, Hao Huang, Yongxiong Ren and Yang Yue from USC; Samuel Dolinar from NASA's Jet Propulsion Laboratory; and Moshe Tur from Tel Aviv University.

Wang, the lead author, left USC after completing this research and is now a professor at the Huazhong University of Science and Technology in China.

Turing Exhibition and Facebook Timeline

In short video introducing the exhibition, curator David Rooney refers to the double meaning of? its title. While Alan Turing is perhaps best known in Britain as one of the World War II code breakers, the fact that he broke the, now obsolete, social code is a facet of his tragically short life that isn't ignored in this exhibition.

The Pilot ACE computer is one of the centrepieces of the exhibition, and is described as, "the most significant surviving Turing artefact in existence."

Given the focus of the exhibition on codebreaking, it is hardly surprising that an Enigma machine is included. In fact there are three such machines one of having been loaned by Rolling Stone Mick Jagger.

The story behind this is itself something of an enigma. Mick Jagger had a fascination with the Enigma machine since details of the codebreaking activities at Bletchley Park first came to public attention with the publication in the 1980's of book such at Gordon Wlechman's The Hut Six Story.

In 1993 he was outbid at an action, failing to buy a 4-rotor naval machine. The machine sold for ?24,172.50, and was included in a subsequent Guinness Book of Records as the most expensive piece of 'radio related equipment'. He did later manage to buy another machine which was used for authenticity in the film 'Enigma', which was the first released from Jagged Films.

This drive for authenticity is somewhat ironic as the plot of the film is true neither to history, nor to the book by Robert Harris on which it was based, in the way it ignores Alan Turing.

The exhibition is about Turing the man as well as about Turing the Father of Computing and the biographical aspects have been cleverly translated to a Facebook page that makes full use of the Timeline feature. It also makes a good repository for links and of course for comments from across the Internet.

It is however poignant to reflect that a man who at times in his life found it difficult to relate to other people should now have a growing circle of Facebook followers.

It may look "nutty" and like a "blender," but the designers say the craft could challenge helicopters

Inventor and physicist Thomas Senkel created an Internet sensation with the October 2011 video of his maiden?and only?test flight of a spidery proof-of-concept 16-rotor helicopter dubbed Multicopter 1. Now the maker of the experimental personal aviation craft, the European start-up e-volo, is back with a revised "volocopter" design that adds two more rotors, a serial hybrid drive and long-term plans for going to 100 percent battery power.

The new design calls for 1.8-meter, 0.5-kilogram carbon-fiber blades, each paired with a motor. They are arrayed around a hub in two concentric circles over a boxy one- or two-person cockpit.

After awarding the volocopter concept a Lindbergh Prize for Innovation in April, Yolanka Wulff, executive director of The Charles A. and Anne Morrow Lindbergh Foundation, admitted the idea of the multi-blade chopper at first seems "nutty." Looking beyond the novel appearance, however, she says, e-volo's concept excels in safety, energy efficiency and simplicity, which were the bases of the prize.

All three attributes arrive thanks largely to evolo?s removal of classic helicopter elements. First, the energy-robbing high-mass main rotor, transmission, tail boom and tail rotor are gone. The enormous blades over a normal chopper's cabin create lift, but their mass creates a high degree of stress and wear on the craft. And the small tail rotor, perched vertically out on a boom behind the cabin, keeps the helicopter's body from spinning in the opposite direction as the main blades, but it also eats up about 30 percent of a helicopter's power.

The volocopter's multiple rotor blades individually would not create the torque that a single large rotor produces, and they offer redundancy for safety. Hypothetically, the volocopter could fly with a few as 12 functioning rotors, as long as those rotors were not all clustered together on one side, says Senkel, the aircraft's co-inventor and e-volo's lead construction engineer.

Without the iconic two-prop configuration, the craft would be lighter, making it more fuel efficient and reducing the physical complexity of delivering power to the top and rear blades from a single engine. Nor would the volocopter need an energy-hungry transmission. In fact, "there will be no mechanical connection between the gas engine and the blades," Senkel says. That means fewer points of energy loss and more redundancy for safety.

E-volo's design eliminates the dependence on a single source of power to the blades. As a serial-hybrid vehicle, the volocopter would have a gas-fueled engine, in this case an engine capable of generating 50- to 75 kilowatts, typical of ultralight aircraft. Rather than mechanically drive the rotors, the engine would generate power for electric motors as well as charge onboard lithium batteries. Should it fail, the batteries are expected to provide enough backup power so the craft could make a controlled landing.

Whereas helicopters navigate by changing the pitch of the main and tail rotor blades, the volocopter's maneuverability will depend on changing the speed of individual rotors. Although more complex, it is more precise in principle to control a craft using three to six redundant microcontrollers (in case one or more fails) interpreting instructions from a pilot using a game console?like joystick?instead of rudder pedals, a control stick and a throttle.

Wulff's first impression about the volocopter's design is not uncommon. E-volo's computer-animated promotional videos of a gleaming white, carbon-fiber and fiberglass craft beneath a thatch of blades recall the many-winged would-be flying machines of the late 19th century. This point is not lost on Senkel.

"I understand these skeptical opinions," he says. "The design concept looks like a blender. But we really are making a safe flying machine."

Poll: 1-in-4 uncommitted now in White House race

WASHINGTON (AP) ? They shrug at President Barack Obama and Republican challenger Mitt Romney. They're in no hurry to decide which one to support in the White House race. And they'll have a big say in determining who wins the White House.

One-quarter of U.S. voters are persuadable, according to an Associated Press-GfK poll, and both Obama and Romney will spend the next four months trying to convince these fickle, hard-to-reach individuals that only he has what it takes to fix an ailing nation.

It's a delicate task. These voters also hate pandering.

"I don't believe in nothing they say," says Carol Barber of Iceland, Ky., among the 27 percent of the electorate that hasn't determined whom to back or that doesn't have a strong preference about a candidate.

Like many uncommitted voters, the 66-year-old Barber isn't really paying attention to politics these days. She's largely focused on her husband, who just had a liver transplant, and the fact that she had to refinance her home to pay much of his health bill. "I just can't concentrate on it now," she says before adding, "If there were somebody running who knows what it's like to struggle, that would be different."

John Robinson, a 49-year-old general contractor from Santa Cruz, Calif., is paying a bit more attention, but is just as turned off by both candidates.

"I'm just bitter about everybody. They just keep talking and wavering," said Robinson, a conservative who backed the GOP nominee in 2008, Arizona Sen. John McCain, but is undecided between Obama and Romney. "There's nothing I can really say that's appealing about either one of them."

To be sure, many of the 1-in-4 voters who today say they are uncommitted will settle on a candidate by Election Day, Nov. 6.

Until then, Obama and Romney will spend huge amounts of time and money trying to win their votes, especially in the most competitive states that tend to swing between Republicans and Democrats each presidential election. Obama and Romney face the same hurdle, winning over wavering voters without alienating core supporters they need to canvass neighborhoods and staff telephone banks this fall to help make sure their backers actually vote.

"It presents an interesting challenge to the campaigns," said Steve McMahon, a founding partner in Purple Strategies, a bipartisan crisis management firm. "Moving to the middle means winning these voters, but it also means creating problems with your base."

Obama has sought to straddle both the left and the middle by announcing policies that expand access to contraception and allow immigrants brought illegally to the United States as children to be exempted from deportation and granted work permits if they applied.

Both issues are popular with his core supporters and centrist voters. The president also is promoting a list of what he says are bipartisan measures that would help homeowners, veterans, teachers and police officers, and he accuses Republicans of causing gridlock by refusing to act on them. It's a pitch intended for independent-minded voters frustrated by inaction in Washington.

Romney has broadened his tea party-infused message from the GOP primary and softened his tone as he looks to attract voters from across the political spectrum.

He abandoned the harsh immigration rhetoric on Thursday when he pledged to address illegal immigration "in a civil but resolute manner" while outlining plans to overhaul the green card system for immigrants with families and end immigration caps for their spouses and minor children. In doing so, he risked inflaming conservatives who make up the base of the Republican Party.

Overall, the poll found that among registered voters, 47 percent say they will vote for the president and 44 percent for Romney, a difference that is not statistically significant.

Those totals include soft support, though, meaning people who lean toward a candidate as well as those who said they could change their minds before November. The poll showed that these persuadable voters are equally apt to lean toward Obama, Romney, or neither, with about one-third of them in each camp.

The survey also showed that these voters are more likely than others to say they distrust both Romney and Obama on the major issues. They are far more likely to think the outcome of the election won't make a big difference on the economy, unemployment, the federal budget deficit or health care.

Party politics and wedge issues have dubious weight with this group. The poll found more independents fall into this category than partisans. The partisans who are persuadable are more likely to be in the ideological middle than either liberal Democrats or conservative Republicans. Seventeen percent of persuadables say they consider themselves supporters of the tea party.

The poll also found that demographically, they are more likely to be members of Generation X (between the ages of 30 and 49) than other registered voters. Many, 71 percent, have not graduated college. They are a bit more likely to have lower incomes than all registered voters. Fifty-two percent of persuadables have incomes below $50,000, compared with 44 percent of all voters.

On other characteristics ? gender, religious preference and race ? they're split similarly to other registered voters.

The Associated Press-GfK Poll was conducted June 14-18, 2012 by GfK Roper Public Affairs and Corporate Communications. It involved landline and cellphone interviews with 1,007 adults nationwide, including 878 registered voters and 228 persuadable voters. Results for the full sample have a margin of sampling error of plus or minus 4.0 percentage points. For registered voters it is 4.2 points and for persuadable voters it's plus or minus 8.3 points.

Cricket: Customers 'Waiting at the Door' For Prepaid iPhone

Apple iPhone 4S (Verizon Wireless)

Just as planned, Cricket Communications has become the first prepaid carrier in the U.S. to offer the Apple iPhone.

Cricket, a subsidiary of Leap Wireless, began selling the iPhone 4 and iPhone 4S to prepaid customers in its stores and through select dealers Friday morning with its $55 per month, unlimited talk, text, and data plan. Cricket customers were eager to get their hands on the prepaid iPhone, the company said.

"So far, customer activity has been brisk with customers waiting at the door as the stores opened," a Cricket spokesman told PCMag in an email.

Cricket late last month announced it would be offering the iPhone to customers without a contract. On Cricket's plan, the 16GB iPhone 4S is available for $499.99 and the 8GB iPhone 4 is available for $399.99. Both come in black or white.

"Launching iPhone is a major milestone for us and we are proud to offer iPhone customers attractive nationwide coverage, a robust 3G data network and a value-packed, no-contract plan," Doug Hutcheson, president and CEO of Leap, said in a statement last month.

Cricket is first prepaid carrier to nab the iPhone but it isn't the only one. Sprint's Virgin Mobile USA division will also begin offering the iPhone on a pay-as-you-go basis, starting on June 29.

T-Mobile is currently the only one of the four major U.S. carriers that does not yet have the iPhone, due to network incompatibilities. Sprint jumped on board with the release of the iPhone 4S, joining Verizon and AT&T as Apple partners.

In April, a number of regional carriers landed the coveted Apple smartphone, including nTelos, Cellcom, and GCI.

Google CEO says "nothing seriously wrong": source

Google Inc CEO Larry Page, who plans to skip several high-profile events in coming weeks after losing his voice, told employees there was "nothing seriously wrong with me," according to a source who had seen an internal staff memo.

Page sat out his company's annual shareholders' meeting on Thursday. The 39-year-old Google co-founder is resting his voice because of an unspecified condition, and he will miss Google's annual developer conference next week as well as its quarterly results announcement next month, executives said on Thursday without elaborating.

Page's prolonged absence from the public spotlight raises questions about his condition, and the company's obligation to highlight issues of concern to shareholders.

Corporate governance experts say Google has met minimal disclosure requirements but will face increasing pressure while Page remains out of sight.

On Friday, Google's shares rose 1.1 percent to $571.48, lifted along with the rest of the Nasdaq.

"It gets them over the first disclosure hurdle, that is they've alerted shareholders to the fact he's going to have this health effect," said James Post, a professor of management at Boston University who focuses on corporate governance issues.

"It's OK for them not to say that. As more information emerges from other sources, the tough questions still lie ahead, and there will be continued pressure to keep answering those tough questions."

Google would not comment on its CEO's medical condition on Friday.

Page, co-founder Sergey Brin and Executive Chairman Eric Schmidt control a majority of the Internet company through special shares that give them more voting power.

That capital structure, emulated by a new generation of Web companies from Facebook Inc to Zynga Inc, grants founders enormous influence over their companies.
